Property and Business Planning Steps 1–5 | Craig A. Fine, Esq.

Property and business planning helps owners, investors, landlords, tenants, entrepreneurs, and business operators organize legal, financial, and operational decisions before problems arise. Future posts in this series will cover steps 6–10, 11–15, and 16–20.

Property and Business Planning Steps: Part 1

The first stage of property and business planning should focus on the documents, obligations, and financial assumptions that support the entire operation. For property owners and business operators, small oversights can later become expensive disputes, delays, compliance issues, or planning problems.

Property and Business Planning Steps 1–5 Foundation

Step 1: Review and update leases regularly. Leases should be checked for rent terms, renewal options, tenant responsibilities, maintenance obligations, default provisions, and notice requirements. Outdated lease language can create confusion when laws, market conditions, or business needs change.

Step 2: Update estate and succession documents. Property and business planning should include wills, trusts, powers of attorney, ownership documents, and succession plans. If property or business interests may transfer to family members, partners, or another owner, the documents should clearly reflect that plan.

Step 3: Stress-test cash flow projections. Owners and operators should review whether cash flow can withstand vacancies, repairs, financing changes, insurance increases, tax obligations, or slower business periods. This helps identify weak points before they become urgent financial pressure.

Step 4: Monitor RGB, HPD, and procurement notices. In New York, property owners and housing-related businesses may need to monitor notices from agencies and public bodies such as the Rent Guidelines Board, HPD, and procurement offices. These notices may affect rent rules, compliance requirements, housing opportunities, and business planning decisions.

Step 5: Consult legal counsel early. Early legal review can help identify risks in leases, contracts, ownership documents, estate plans, financing documents, regulatory notices, and business agreements. Craig A.
