Open Permits and Property Records in a Staten Island Purchase

A Staten Island home purchase involves more than agreeing on a price. A finished basement, rear addition or converted garage may look ready to use, but the buyer still needs to understand the property records and whether the intended use raises questions. Reviewing those records early gives the parties time to investigate discrepancies before closing becomes urgent.

Start with the address and the intended use

Tell your attorney what you plan to do with the property. A buyer seeking a family home may have different concerns from someone planning to rent a unit or operate a business. Provide the listing, contract, inspection report and any seller-provided plans or approvals. Do not assume a description in a listing establishes the legal status of an improvement.

Check both city building-record systems

The New York City Department of Buildings provides access to property information through BIS and DOB NOW. Its building-data guide explains the available records. BIS includes older job applications and permits; newer filings may appear in DOB NOW. A review may involve both systems rather than treating one search as a complete answer.

Keep copies of the records you find, including the address, job number and date of the search. Ask the appropriate professional to explain unfamiliar entries. A permit, complaint, violation and completed application are different things. An online record alone does not establish every fact about the condition of the building.

Compare the records with the actual property

A practical review compares the inspection findings and the seller’s documents with the property records. If a space is advertised as an additional apartment, or a substantial alteration is visible, identify the supporting documentation. Questions about approved occupancy, construction work or a missing sign-off may require an architect, engineer or other qualified professional as well as legal review.

For example, a buyer may notice a rear addition that is not explained by the documents supplied. The useful response is to request the relevant plans, permits and completion records, not to assume either that the addition is illegal or that it is automatically acceptable. The investigation should clarify what is known and what still needs professional assessment.

Coordinate the contract, lender and closing

Raise unresolved issues with counsel before contractual deadlines pass. The parties may need to discuss documents, further inspection, a proposed correction or the allocation of responsibility. The lender and title professionals may have separate requirements. Whether a particular arrangement is appropriate depends on the contract, financing, property and professional advice; a closing date alone does not resolve the underlying question.

Keep a short written checklist: the issue, the document requested, the person responsible, the next deadline and the unresolved question. This makes follow-up easier and helps avoid relying on an informal assurance that has not been documented.
